Bad Judge Award

The following may sound like sour grapes but trust me, that is not the case. I am just very upset with judges who do not believe that even non lawyers can sometimes be right or judges that do not follow the law. Any judicial officer can reply to anything said about them. I will show at least 2 replies. Opinions on this page are the opinions of someone who sent them in and do not necessarily represent my views. By submitting a remark about a particular judge, you give the Rebel the right to publish the remark in whatever place he wants. Keep your eye on this page. I will soon be posting another story about Julius Title who just retired and is going into private arbitration where he can make more money. In my opinion, this is the most unknowledgeable judge I ever ever met and who should stay away from the law altogether. Judge Lois Haight, of the Superior Court of Contra Costa County, is the most unfair and incompetent judge anyone could face. She acts above the law, ignores evidence, and punishes defendants with completely unfair sentences based on their crimes. For example, she sentenced my son two years ago to six months at the Judge Haight Hilton (Byron boys ranch) for a first offense misdemeanor charge. She just sentenced an innocent young man to six months at the ranch for absolutely nothing - except playing basketball. She actually over-rode the recommendation of the probation department - stating the individual that wrote the report was incompetent (like she isn't). She then went as far as to assign another probation officer to write a report that better meets her requirements.

Judge Haight is an evil woman who should not be in a position to Judge anyone and need to be removed from the bench as soon as possible. Anyone facing this woman should do everything in their power to have their case moved to another judge, and hire the best lawyer you can find and afford. An appeal of any kind will only make matters worse because she sees this as an attack on her judgment - which it probably is.

Keep in mind, in a juvenile court, you don't have any real chance of defending yourself. Your case will be based on a probation officer's report that is sent to the DA. The DA regurgitates the information in the report to the judge - whether its factual or not. The sentence Mrs.. Haight imposes will be based on her own discretion - nothing else. The probation report is just a briefing document. If it meets her needs she'll use it. If not, she'll ignore it and request one that meets her needs.

As far as I can see, their is no oversight on this Judge. She acts above the law, is rude, condescending and has absolutely no desire to hear the truth.

If you end up in her court room - you're screwed. Avoid her at all costs.

He refuses to acknowledge the outrageous abuses by the Henderson Police Dept. (if you dont think so, try living there), and rules according to one's attitude toward the police. Who in Henderson NEVER LIE. Word of caution, if you are a male accused falsly or otherwise of domestic violence, you;re screwed. Even if you are innocent he will even try to force you to attend a domestic batterer class.......that oh by the way, he has a financial interest in. Too bad the real judges and politicians in Hnderson and Nevada dont seem to mind his "good ol boy" brand of justice. this clown has no business on the bench. PERIOD

Judge Lawrence Rittenband (deceased) (Santa Monica Superior court) tops the list of my Bad Judge award for not respecting anyone appearing before him who is not an attorney. After sanctioning me for no reason at all, at least by my survey of other attorneys who were in the court at the time, he said I should go to law school. I was told before appearing before him to "look out" because he hates non lawyers taking up the courts time. Another attorney told me he hates anyone who did not go to law school.

Commissioner Leventhal in the West District of Los Angeles County deserves my Bad Judge award for permitting reference to certain documents in a Small Claims action without first showing them to me as required in a Small Claims action. Based on that testimony he ruled against me who had no possible appeal.

Lothrop E. Smith, the judge in my lottery trial that I write about in Chapter 8 of my book the Rebel, is given my Bad Judge award for not having the guts to find me not guilty. I believe that any California Lawyer will agree, after reading the story, that I was not guilty. Especially when these words (taken from the transcript) "In this case, while theoretically, I suppose, it is possible that no quid pro quo would have to be paid in every case. It is also very evident that the game couldn't last very long unless it was.

Every once in a while I appear before a judge who seems to dislike non lawyers. They seem to want to be holier-than-thou and dislike it when the non attorney knows more about the law than they do. California Commissioner Ralph A Amado gets my bad judge award for being one of those judges. At a trial for a speeding ticket I received, I objected to a traffic survey that was not done within the five years preceeding my ticket. Amado said it does not need to be done within 5 years and overruled my objection. I started to argue the point with him but in a nasty voice said “I am not going to argue with you sir. I’ve made a ruling on your motion, the court has overruled your objection.” A bit later I again objected to the traffic survey being too old to sustain a conviction. He then said, “You have already made that objection and I have overruled that objection, alright? I said I was just renewing it... He interrupted me and asked, "Renewing it for what reason? You can renew it till the cows come home. The court has already ruled on it, alright. I am not going to consider it again. NEXT" He was by now very angry with me. I knew the old traffic survey was too old to sustain a conviction but I wanted to bring it the attention of the Appellate Department when I appeal his ruling. On March 24, 2005, almost 9 months after my trial, the Appellate Court agreed with me:

"REVERSE: The judgment is reversed, and the matter is remanded to the trial court with instructions to dismiss the charge. The record on appeal includes an engineering and traffic survey dated May 28, 1998, and certified by an engineer on June 3, 1998. The survey further indicates that actual field data was taken in April 1998. Appellant's alleged violation occurred on November 11, 2003. The survey was conducted more than five (but less than seven) years prior to the date of the violation. Accordingly, the prosecution was required, among other things, to show that the radar unit was calibrated within three years of the date of the alleged violation and was calibrated by an independent agency, and met or exceeded "the minimum operational standards of the National Traffic Highway Safety Administration" as required by Vehicle Code section 40802, subdivision (c)(1)(D). It did not do so. Retrial is prohibited by the double jeopardy clause of the Fifth Amendment. (Burks v. United States (1978) 437 U.S. 1, 11.)

I have met many great trial judges as can be read about in my book The Rebel shown above. But I have also met some who seem to lack the confidence in themselves and need to project a powerful image so they can be taken seriously. Commissioner Amado was one of those.

My next Bad Judge award goes to Santa Monica, CA Judge pro tem Gloria Blume. In a recent case against the Department of Transportation of the City of Los Angeles, I appeared for a trial de novo as permitted in section 40230 of the California Vehicle Code. No witnesses appeared for the city. Prior to trial I argued with her that I have a Constitutional right to confront the city and cross examine their witnesses. Her response to me was: "This is an infraction I believe, so you do not have that right" I then told her: "Then you don't agree with 40230.5 where I am entitled to a trial de novo?" Her response was: "actually, I am not as conversant in that. But I will hold and affirm the judgment (Of the Administrative Hearing Officer) that you owe the City forty-five dollars." I fail to understand how any competent lawyer sitting as a judge can render a decision without at least referring to the Vehicle Code to find that I was right and the case should have been dismissed. The Appellate department of the Superior Court refused to order the lower court to give me a trial. The California District Court of Appeal also failed to give me a trial. The case, as of September 11, is now awaiting a response from a Petition for Review in the Supreme Court of all that has happened so far. Keep reading in a few weeks. Ray Weiser in the Fairfield Traffic Court was given a Rating of 3 on our Rate a Judge Page. He upheld a ticket given for an illegal lane change citation given for pulling into a bike lane as the driver was pulling over for the citing officer. The lane change ticket was given because the officer had no grounds for a speeding ticket, as the new street had no prima facie limit, nor a posted one. The commissioner was unable to grasp the concept of "entrapment" when explained to him, something we should all expect from our justices, apparently. Extremely disappointing and dim-witted in most regards.

Referring to Judge Title, someone wrote in and asked "How long ago did this judge retire?" The answer is that I don't know but from the looks of him I would guess his age at about 97 years old and very unknowledgeable of the law.

This judge has the worst reputation in the state of South Carolina for not bothering herself with the written law when it comes to hearing bench trial cases. She blatantly ignored my claim against the defendant that ripped me off for a substantial amount of money even though I quoted the article's of law to her (which there were several) which all protected me as a consumer. I had to hire an appeals attorney at great expense to myself to overturn this outrageous ruling. The appeals court date has not been set yet but the attorney and his partners have assured me that this decision will be overturned and that this judge will soon be on her way out as a judge for other bad rulings she has made since her inception on the bench.

I had a civil case where I wasn't properly served papers. A judgment was taken against me where I filed a motion to set it aside based on I was not properly served. Service was to a WM John Doe 40 250 co-tenant (so it said). When I went in front of this judge in hopes of having my day in court and to get an extension, he pretty much told me to pound sand and made the judgment stand. This judge should be removed for violating my rights in having my day in court. Just because I was not represented he treated me like I was just a dumb person. However, I am not stopping here I want to go to the top with this one.

While holding a tenant's lease in her hand, showing that he had 4 months left to go on the lease, and fully paid rent, declared the tenant guilty of "unlawful entry with intent to destroy property". This accusation was made by the landlord, in retaliation for his starting a tenant association, to assist other tenants in filing housing code violations, and taking the landlord to small claims court to recover their rightful security deposits.

This judge is in the same form as Chuck Weller. He makes snap judgements, rulings against men because mothers are "better cheerleaders". Awards attorney fees to the adverse party even when it was clear that she was the one using the court to harass me!!! Will not fine for contempt if the other party has no money. The adverse party cost me $4000 in attorney and other fees for a false TPO she filed, then he REFUSED to award me attorney's fees. He admonished her for the action, but found she had no money so would not make the order!

This judge was mad because Texas dared question his ruling on jurisdiction. Both states have declared jurisdiction over my grandson. My grandchild lived in El Paso with his mother and he spent time with his grandparents in New Mexico. She then decided to move to Fort Worth to try and be a family with my son. That didn't work and she left after only a week (leaving the child). She lied under oath stating that the child never lived in El Paso and that she kept an apartment for convenience. She was on state aid, not the type of person who keeps an extra residence. She was given an overnight visitation when she was in Fort Worth for court and fled the state back to New Mexico. We asked for a motion to reconsider jurisdiction in New Mexico because of her bad behavior. The judge there denied it and still said he had jurisdiction. My son did not participate in the custody hearing because he did not want to give up his right to appeal. The judge order no visitation unless my son dropped his Texas proceedings. He also questioned our judge in Texas and ruled all of her orders void!! Of course that doesn't hold any wait, but what an ego. How can a judge take a child away from his father and give no visitation just because his ego is getting in the way? The family that our grandchild is living with has a long history of mental illness and criminal activity. The judge never ordered a home study or even questioned where the child would be living. The baby's mother is a diagnosed schizophrenic and so is her sister that is living with them. The sister's children have already been removed by CPS. This judge has taken away my son's only child and our only grandchild just because he is vindictive and has "black robe disease".
